(4) The forecast trajectory for the 

balance of the flight. 

(5) The forecast time and location of 

impact with the surface of the earth. 

(c) If a balloon position report is not 

recorded for any two-hour period of 
flight, the person operating an un-
manned free balloon shall immediately 
notify the nearest FAA ATC facility. 
The notice shall include the last re-
corded position and any revision of the 
forecast trajectory. The nearest FAA 
ATC facility shall be notified imme-
diately when tracking of the balloon is 
re-established. 

(d) Each person operating an un-

manned free balloon shall notify the 
nearest FAA ATC facility when the op-
eration is ended.

§ 101.41

Applicability. 

This subpart prescribes rules gov-

erning the operation of a model air-
craft (or an aircraft being developed as 
a model aircraft) that meets all of the 
following conditions as set forth in sec-
tion 336 of Public Law 112–95: 

(a) The aircraft is flown strictly for 

hobby or recreational use; 

(b) The aircraft is operated in accord-

ance with a community-based set of 
safety guidelines and within the pro-
gramming of a nationwide community- 
based organization; 

(c) The aircraft is limited to not 

more than 55 pounds unless otherwise 
certified through a design, construc-
tion, inspection, flight test, and oper-
ational safety program administered 
by a community-based organization; 

(d) The aircraft is operated in a man-

ner that does not interfere with and 
gives way to any manned aircraft; and 

(e) When flown within 5 miles of an 

airport, the operator of the aircraft 
provides the airport operator and the 
airport air traffic control tower (when 
an air traffic facility is located at the 
airport) with prior notice of the oper-
ation.

Endangering the safety of the

Subpart A—General 

§ 103.1

Applicability. 

This part prescribes rules governing 

the operation of ultralight vehicles in 
the United States. For the purposes of 
this part, an ultralight vehicle is a ve-
hicle that: 

(a) Is used or intended to be used for 

manned operation in the air by a single 
occupant; 

(b) Is used or intended to be used for 

recreation or sport purposes only; 

(c) Does not have any U.S. or foreign 

airworthiness certificate; and 

(d) If unpowered, weighs less than 155 

pounds; or 

(e) If powered: 
(1) Weighs less than 254 pounds empty 

weight, excluding floats and safety de-
vices which are intended for deploy-
ment in a potentially catastrophic sit-
uation;
